The regulations and rules surrounding medical marijuana use in the areas above is yet to be approved. Due to this shortcoming, medical marijuana dispensaries have not yet opened. It is important to note that recreational cannabis is still illegal in USVI, but the legalization process is underway. Governor Albert Brian Jr legalized medical marijuana in 2019. Even though medical marijuana was legalized through a Senate bill that passed 9-4, the product is still not available in the Virgin Islands. The reason medicinal cannabis is still unavailable in the VI is that the VI Cannabis Advisory Board is yet to reach a quorum. The cannabis advisory board hopes to achieve a quorum by June or July of 2022.

Although the VI Cannabis Advisory Board has not reached quorum, it has to come up with a couple of regulations on the use of medical marijuana. Once medical cannabis hits dispensaries, getting a medical card as a USVI resident will cost you an annual fee of $50. If a visitor wishes to use the medical cannabis in US VI, they’ll be required to get a temporary medical marijuana card. Tourist medical cards will cost way more than resident cards, and they will go for:$50 for 5 days, $75 for 10 days, and $100 for 30 days. A Virginia Island residents with a medical cannabis card will be allowed to grow up to 12 cannabis plants. It is important to note that medical marijuana cards from other jurisdictions outside the Virgin Islands will not be honored.

It is not likely that recreational marijuana will become legal in their USVI anytime soon. Even though cannabis was decriminalized in USVI, people who use it for creational purposes can be fined or imprisoned. It is advisable for you to know the penalties that apply for cannabis possession and distribution in USVI. If the authorities confiscate more than 10 oz of cannabis from you, the fine will be way higher and you could even end up serving time. Minors who are caught abusing marijuana will have the product confiscated from them and they’ll be forced to attend a drug awareness program. The penalties for smuggling or growing marijuana are still quite stiff compared to the others.

As long as a CBD product does not contain THC, there are no regulations that prohibit its use or sale in the Virgin Islands, especially in St. Thomas, St. John, and St. Croix.
